Specific Requirements

Pre-confirmation (the beginning):

In addition to your Petition, Statement of Financial Affairs, Plan, AAPD, Schedules, and Income Statement, you (through your attorney) are required to file the following through the Bankruptcy Court Clerk:

Pre-Petition Credit Counseling Certificate 

Income Records

*Tax Return Affidavit

*Domestic Support Obligations Affidavit (Only if there is an Obligation)


Post-Confirmation (during or near/at the end)

Financial Management Certificate

Address Changes

*Debtor Certification and Motion for Entry of Chapter 13 Discharge (Pursuant to 

11 U.S.C. § 1328(a))

In addition to the required items for a consumer case, all business case debtor(s) must also submit:

*Twelve (12) Month Projected Cash Flow of the business

* Profit and Loss Statement for Six (6) months prior to filing

Tax Deposit Statements

*Trustee’s Business Questionnaire

Bank Statements - Copies of last Six (6) months on all accounts accessed by Debtor(s) and monthly thereafter until the case is confirmed

Any Business Insurance- Copies of Declarations Page

Frequently Asked Questions

No. Payments may be mailed to PO Box 94210, Lubbock, Texas 79493. The most secure payment method is through an established TFS account at www.tfsbillpay.com

*Please ensure your case number is referenced on your payment method. NEVER send cash.


The Trustee may not accept emailed tax returns. The most secure way to send them is directly through your attorney. Please remember to redact your social security number and to reference your case number.


If your refund is over $2,000, then you may owe the amount over $2,000 to the Trustee.  The Trustee will send you a letter to advise you of the amount of the excess refund that you are required to submit to the Trustee. A hearing will also be set by the Trustee that applies your refund to your case.  If you have a reason that you need to keep your refund, contact your attorney. 


The easiest way to track your case is through the National Data Center. You may register at www.ndc.org. It is completely free to you as a Debtor. It is the best way to track of all the payments you have made, the creditors that have filed claims, and which creditors are being paid.


It is of the utmost importance to contact your attorney as soon as possible. Your attorney will assist you with the insurance company and discuss the possibility of purchasing another vehicle.
